Verizon Man Cave Make Over Contest Official Rules
NO PURCHASE NECESSARY TO ENTER. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. OPEN ONLY TO LEGAL RESIDENTS OF STATE OF PENNSYLVANIA WHO ARE 18 YEARS OF AGE OR OLDER.
INTRODUCTION. This "Verizon Man Cave Make Over Contest" (the "Contest") gives Entrants the opportunity to submit a video or a still photograph with up to three sentences of explanatory text which demonstrates why they deserve to win a Man Cave Make Over from Verizon. The details of the prizes and how to enter the Contest are contained in these Official Rules. The Contest begins on or about 12:01 a.m., Eastern Standard Time on Oct. 6, 2009 and ends at 11:59 p.m. Eastern Standard Time Nov. 30 2009 (“Contest Period”). Sponsor’s computer shall be the official clock of the Contest. Any Entries received by Verizon after the Contest Period ends will be automatically disqualified from the Contest.
During the Contest Period there will be four separate entry periods (the “Entry Periods”) for Fan Favorite prizes where viewers may vote for Entries received in that Entry Period as follows (all times are EST):

SPONSOR: Verizon Corporate Services Group, Inc. (“Verizon” or “Sponsor”), 140 West Street New York, NY USA 10007.
ELIGIBILITY. The Contest is open only to individuals who reside in a Pennsylvania residence, can subscribe to Verizon FiOS Internet and FiOS TV services as determined by Sponsor (entries originating from any other jurisdiction are not eligible) and who are 18 years of age or older at time of entry. Entrant must also have obtained all necessary permissions from anyone else featured in his/her Entry, including permission from parents or legal guardians of minors including in such Entry. No responsibility is assumed for any disputes which may arise among an Entrant and any individual who may have a collective/creative interest in any Entry in connection with this Contest. Such disputes will not be resolved by the Sponsor. In the event that any such dispute interferes with the operation of the Contest, the Entrant(s) involved in the dispute may be disqualified, in the Sponsor’s sole discretion. Employees of Verizon and their respective affiliates, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners) eligible to participate in this Contest.
Potential Grand Prize winners must inhabit a residence which is eligible to subscribe to Verizon FiOS Internet and FiOS TV Services, must be available for scheduled installations, must be willing and able to accommodate Sponsor's Grand Prize delivery schedule, as solely determined by Sponsor. Potential Grand Prize winners must agree to the filming of all Grand Prize delivery and installation processes. Further, winners must agree to allow Sponsor, without limitation, to use and publish his/her name (or any fictional name), address (city and state), picture, portrait, image, photograph, video footage, or other likeness and/or voice as well as video and text of any interview or comment he/she may give to Sponsor for advertising or promotional purposes in any and all media, whether or not now known, throughout the universe in perpetuity, without limitation, further payment, consideration or notice. Potential winners must agree to waive the opportunity and right to inspect or approve any such advertising or promotional materials.
HOW TO ENTER. During the Contest Period, submit a video or photograph with up to three sentences of explanatory text (the “Entry”) that demonstrates why the Entrant deserves to win a Man Cave Make Over from Verizon over everyone else entered in the Contest.
There are three (3) ways to submit an Entry:
(1) At selected Verizon FiOS events, legibly complete the registration and publicity release form, available while supplies last, from an Event Staff Member, including your name, home address, city, state, ZIP code, daytime phone number, and e-mail address. Record your video inside the Verizon FiOS booth. A schedule of event dates and locations is available online at www.noplacelikefios.com/mancave (“the Web site”). An Event Staff Member will upload your video or photograph to the Web site.
(2) Visit the Web site, enter your e-mail address, and proceed to complete the online registration form, including your name, home address, city, ZIP code, and daytime phone number and check the “I Agree” box to agree to be entered into the Contest including, without limitation, electronically agreeing to the terms of these Officials Rules; and electronically agreeing to the terms of use of the Verizon Privacy Policy. Click “enter” and follow the instructions to upload your video or photograph. Incomplete or inaccurate entry forms are void.
(3) Entrants may submit an Entry via mail to Verizon FiOS Man Cave Make Over Contest, c/o Winning Strategies, 550 Broad Street, Newark NJ 07102 on video tape or DVD.
All Entries may be no more than 5 minutes in length. Acceptable video formats are: .WMV, .AVI, .MPG, .FLV, .MOV or Quicktime format (transmit a copy of the digital video file). Acceptable photographic formats are .JPG, .GIF, .PNG. All Entries must be in English. All Entries entered into the Contest must have come from an original master that meets one of the aforementioned acceptable formats. Sponsor reserves the right to reject any Entry which, in its sole and absolute discretion, is determined not to meet the above specifications. Entries must fully comply with the Verizon Website Terms of Use, as set forth at www22.verizon.com/terms.
By doing the above, eligible entrants will be entered into the Contest and will each qualify as an entrant ("Entrant", "you" or "your").
Limit one (1) Entry per Entrant during the entire Contest Period, regardless of method of submission or the Entry Period in which the Entry was submitted. Entries for each Entry Period must be received during the time periods provided above. Group or joint Entries will not be accepted; a single individual must be identified as the producer or Entrant for an Entry. Any attempt by any Entrant to submit more than one Entry using multiple/different identities or any other methods will void all such Entries, and that Entrant may be disqualified.
CONDITIONS OF ENTRY. By participating in this Contest, Entrants agree to be bound by these Official Rules and by the decisions of the Sponsor, which shall be final, conclusive and binding in all matters relating to this Contest. Each Entrant may be required to sign (a) an affidavit of eligibility and liability release to release the Sponsor and its respective employees, from any and all liability, claims, demands and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Contest or the use or acceptance of any of promotional opportunities and/or prizes received, (b) except where prohibited, a promotional release granting the right to use his or her name and likeness for advertising and publicity purposes without additional compensation, and (c) any relevant tax documentation. Entry into this Contest constitutes each Entrant's agreement to sign such affidavit and release form(s). Failure to sign and return any of the documents when requested may result in disqualification and selection of an alternate winner.
ANY VIOLATION OF THESE OFFICIAL RULES BY ANY ENTRANT WILL RESULT IN SUCH ENTRANT'S DISQUALIFICATION AS A POTENTIAL WINNER OF THIS CONTEST. Upon receipt of a prize, any Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations.
Each Entry must be wholly original, created solely by the applicable Entrant, not copied in whole or in part from any other work and may not have been previously published or submitted to any other competition or contest. Each Entrant is responsible for and must have obtained all necessary approvals, releases, licenses, rights or other authorizations, consents and permissions to all underlying elements, works, likeness or properties incorporated into the Entry and necessary to use Entry for any purpose. Entrant will be able to furnish satisfactory (as determined by Sponsor in its sole discretion) proof of such approvals, licenses, consents and permissions to Sponsor upon Sponsor’s request. Each Entry must not contain the trademarks, designs, copyrighted works or intellectual property of any third parties or otherwise infringe or violate the rights of any third party, including but not limited to trade secrets, licensing rights, right of publicity or any other right not owned by the Entrant. The Entry shall not be subject to any third party agreements and Sponsor will not be required to pay or incur any sums to any person or entity as a result of its use of the Entry.
Entrants further agree to assign all right, title and interest in all material to the Sponsor and agree to sign such documentation as is necessary to formalize this assignment. Without limiting the foregoing, Entrants acknowledge and agree that the Sponsor is under no obligation to use any materials submitted by Entrants in connection with the Contest.
Entries will not be accepted or eligible if they contain content or material of any kind that violates or is inconsistent with these Official Rules, including, without limitation, any content that contains (or appears to contain):
(i) profane, threatening, hateful or obscene material;
(ii) endorsement of (or condones) illegal drug use, alcohol abuse or other illegal activity;
(iii) nudity, profanity, extreme or gratuitous violence;
(iv) any express or implied commercial endorsement; any derogatory characterization of any person or group based on age, race, color, gender identity and expression, sexual orientation, religious beliefs, marital status, mental or physical disability, citizenship, creed, national origin, physical appearance, political affiliation, union membership, or other ethical or unlawful factors;
(v) any unauthorized use of copyrighted or proprietary material or any unlawful material; or
(vi) depictions of any conduct, language or other context deemed inappropriate by the Sponsor.
Sponsor reserves the right to reject any Entry and disqualify any Entrant which, in its sole and absolute discretion, is determined to be offensive, inappropriate, violates any of its policies or otherwise violates these rules. If Sponsor rejects any Entry, in its sole and absolute discretion, such Entry will not appear on the Web site and will not be considered a valid Contest Entry. No correspondence will be entered into with regard to such disqualified Entries.
USE OF THE ENTRY: Once submitted, the Entry is and shall remain the property of Verizon or its respective licensors, suppliers, promotional partners and/or any other persons, firms or entities that hold and own the rights to these (including, without limitation, the intellectual or industrial property rights). Verizon reserves all rights not specifically granted to Entrants under these Official Contest Rules. Entrants may not use the video or photograph for any commercial, promotional, or other purposes, other than for submission of the Entry as an entry into the Contest pursuant to the terms and conditions contained herein.
CONTEST PRIZES: "Verizon FiOS Man Cave Make Over Contest" will award one (1) grand prize package ("Grand Prize") , One Second Prize, and One Third Prize, plus four Fan favorite packages (collectively, “Prize Winner(s)”). The Sponsor will determine each Prize Winner consistent with these rules and all decisions by Sponsor relating to this Contest are final.
Grand Prize Judging Criteria: All eligible Entries received during the Contest Period will be judged based on the following criteria: (a) How well does the Entry answer the overall question "Why do you deserve to win the Verizon FiOS Man Cave Makeover?" – up to 100 points; (b) Entry content is creative and the presentation is unique – up to 100 points; (c) A compelling story presented in an engaging way and with an impactful message – up to 100 points; and (d) high placement in overall rankings of voting – up to 100 points. In the event of a tie, all tied Entries will be scored again based on criteria (c): Entry content is creative and the presentation is unique – up to 100 points. Entries will be judged by a panel chosen by the Sponsor. Sponsor's and Judge's decisions are final.
Grand Prize Winner Selection: Sponsor, in its sole discretion, will evaluate each Entrant's ability to: (a) accept, (b) fully utilize, and (c) fulfill the obligations of acceptance of the Grand Prize, based on, but not limited to, the following: Confirmation that a potential winner's living space is fully in compliance with all building codes; confirmation of Sponsor's ability to secure permissions from relevant organizations and associations; Sponsor's ability to secure permission from landlord/building owner to install equipment; confirmation that adequate spaces and appropriate locations are available for Grand Prize components in potential winner's living space.
Fan Favorite Judging and Selection Criteria: Fan Favorite winners will be selected four times throughout the Contest, one winner for each Entry Period listed above. Fan Favorite winners will be selected based upon achieving highest number of votes for the respective Entry Period, in addition to creativity and adherence to the contest theme. All these factors will be weighed by the Sponsor whose decisions is final in all matters relating to this Contest and which will conduct winner’s selection and verification.
A Fan Favorite winner is also eligible to win the Grand Prize, Second and Third Prizes.
VOTING: Voting is invited from individuals who register on line. Registrants may vote for their own or other Entries for a total of up to five (5) votes per Entry per day through the course of the Contest Phase. All registrants must provide a valid e-mail address and other contact information as requested on the registration page, and only five votes per day will be accepted from each valid e mail address. Use of multiple e mail addresses for a single registrant is prohibited. Voting cannot be assigned, designated or authorized to other users; all registrants are limited to one e mail address and five votes per day on that e mail address. False information provided in the registration process may be grounds for disqualification.
Any votes created or reasonably suspected of being created by macro, programmed, robotic or other methods will be removed, and any Entrant that Sponsor suspects of using such methods, directly or indirectly, will be disqualified. Sponsor reserves the right to reject any Entry and disqualify any Entrant in its sole and absolute discretion. If Sponsor rejects any Entry, in its sole and absolute discretion, such Entry will not appear on the Web site and will not be considered a valid Contest Entry. No correspondence will be entered into with regard to such disqualified Entries.
Claiming Prizes. Sponsor will attempt to notify the Grand Prize Winner, the Second Prize and the Third Prize by e mail and/or telephone before December 11, 2009 that they are potential winners of this Contest.
Notification and announcement of Fan Favorites will occur on or around the following dates: Oct. 14, Nov. 2. Nov. 16 and Nov. 30, 2009. Sponsor will attempt to notify the Fan Favorite winners by phone and/or e mail Fan Favorite Winners are also eligible to win the Grand Prize, the Second Prize and the Third Prize if they meet the criteria as set forth above.
A potential winner may be requested to provide the Sponsor with proof that he/she is the authorized account holder of the e-mail address associated with the winning entry and will be required to furnish proof of eligibility (including but not limited to proof of US residency, age) as a condition of receiving the Prize. Eligibility shall be determined at the sole and absolute discretion of the Sponsor.
The potential Prize Winners must execute and return an Affidavit of Eligibility/Release of Liability within two (2) days of notification. Noncompliance within this time period may result in disqualification and an alternate winner may be selected. Return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner. In the event of non-compliance with these Official Rules, if a potential winner is deemed ineligible, declines prize or fails to complete and return forms within time period specified or if any forms are returned as undeliverable, prize will be forfeited and awarded to Entrant according to the winner selection criteria as set forth above.

The approximate retail value ("ARV") of the Grand Prize is $10,000 and is subject to change based on current market conditions. The total ARV of the Second Prize is $200 and the total ARV of the Third Prize is $1000 The ARV for the second and third place prizes are subject to change based on the then current market conditions at time of the prize fulfillment. The total ARV of each Fan Favorite Prize is between $100-250. The aggregate ARV for the total Fan Favorite prize packages associated with this Contest is $1000.
Any difference between the ARV of any of the Prizes and the actual value, if any, will not be rewarded. If for any reason any prize-related event is delayed, cancelled or postponed, the Sponsor reserve the right, but is not obligated, to cancel or modify the Contest in its discretion and shall award a substitute prize of equal or greater value, which may include, but is not limited to, a cash prize equivalent to the Grand Prize as set forth in these Official Rules. The date for fulfillment of the Grand Prize and the other prizes will be on or around March 2010, and such dates are subject to change in Sponsor’s sole discretion.
The Prize Winners also hereby acknowledge that Sponsor has not and will not obtain or provide insurance of any kind relating to the Prizes and that Prize Winners (and any guest) will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Prizes.
All federal, state and local taxes related to the Prize packages are the sole responsibility of the respective winner. No refunds or credit for changes are allowed. No transfer of the prize is permitted. No substitution, transfer of any prize (or any part of the Prize package) or cash alternative will be permitted, except by Sponsor due to prize unavailability at time of award in which case a prize of equal or greater value will be awarded. Unless specified otherwise by Sponsor, no cash will be awarded.
Arrangements for fulfillment of the Prizes will be made by Sponsor. All costs and expenses not specifically listed above, including, without limitation, meals, snacks, beverages, tips, souvenirs, personal expenses, any equipment to be used in connection with the Prizes are solely Prize Winner's responsibility. The value of the Prizes may be taxable to Prize Winner as income. Prize Winner must supply Sponsor with his/her social security number for tax purposes. An IRS Form 1099 will be issued in the name of each Prize Winner, or if a minor, in the name of his/her parent or legal guardian, for the actual value of the Prizes received. Upon entry into the Contest, Prize Winners (as well as all other Entrants) are required to comply with any and all applicable federal, state, and local laws, rules, and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely the Prize Winner's and responsibility. Sponsor shall have no responsibility or obligation to a Prize Winner or potential Prize Winner who is unable or unavailable to accept or utilize the Prize as described herein.
USE OF DATA and AGREEMENT TO OFFICIAL RULES. The Sponsor will be collecting personal data about Entrants (including, without limitation, e-mail addresses) when Entrants enter the Contest. By participating in the Contest, Entrants hereby agree to all personal information uses and disclaimers as explained in Verizon’s Privacy Policy (http://www22.verizon.com/privacy/). Participation in the Contest further constitutes Entrant's full and unconditional agreement to and acceptance of these Official Rules and Privacy Policy and willingness to be contacted by telephone and/or email.
The Sponsor shall have an irrevocable, perpetual, universe-wide, fully paid-up and royalty-free license to copy all Entries and to use, re-use, publish, and re-publish such Entries in whole or in part, individually or in conjunction with other photographs or images, in any and all media now known or hereafter devised and for any purpose whatsoever, including, without limitation, for use on merchandise, throughout the universe (including, without limitation, illustration, promotion, advertising and trade), and to use the name of each Entrant in connection therewith if the Sponsor so chooses in its sole discretion. Each Entrant agrees that they will not be compensated for submitting any Entries or for any use of Entries by Sponsor.
Past experience has confirmed that contests and other competitions generate substantially similar submissions or entries which closely resemble concepts and ideas that have been independently developed by the Sponsor before or after the Contest. Accordingly, Entrants may subsequently see a presentation which seemingly incorporates an idea or concept or includes materials similar to that contained in their Entry. Any similarity is purely coincidental and unavoidable in light of the volume of ideas which the Sponsor routinely consider in the course of their program development. Because of this possibility, Entrants hereby agree: (i) that all materials submitted become the property of the Sponsor and (ii) that Entrants indemnify and hold harmless the Sponsor and its respective principals, subsidiaries, affiliates, directors, officers, employees and agents heirs, executors, assigns and designees (collectively, the “Releasees”) from any claims, suits, losses damages and expenses (including reasonable attorneys' fees) that arise from any breach of these Official Rules or from any and all claims and demands arising out of or in connection with their participation in the Contest or the use of such Entries, including, without limitation, any claims for copyright infringement, defamation or invasion or privacy.
GENERAL CONDITIONS. The Contest is governed by the laws of the State of Pennsylvania and Entrants in the Contest hereby consent to the exclusive jurisdiction of those laws for any causes or controversies arising out of the Contest.
Each Entrant waives any and all objections to jurisdiction and venue in these courts. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Contest may only be entered in or from the state of Pennsylvania and entries originating from any other jurisdiction are not eligible for entry. Except where prohibited by law Winner grants to Verizon (and its advertising agencies) the right to use and publish Winner's photo, proper name, likeness, voice, opinions, biographical information and state in any media to promote the Sponsor and the Contest without additional compensation.
For Entries posted on the Web site, Entrants acknowledge and agree that (a) while the Sponsor will seek to accurately present these Entries on the Web site, the Entries as posted on the Web site may differ from the Entries as originally submitted by Entrants due to technological malfunction, error, defect, limitation and/or modifications and the Sponsor and its agencies shall have no liability related thereto; (b) the Sponsor may post Entries in any order, format or pattern, at its sole discretion; (c) the Sponsor may append comments/commentary of their sole choosing, to one or more Entries in its sole and absolute discretion; and (d) Entrant hereby releases and discharges the Releasees (as defined below) from all liability resulting from any distortion, alteration, or faulty reproduction which may occur in the dissemination or use of any of Entry.
The Releasees do not assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. The Sponsor shall not be responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or any other errors related to the Entry or any failure to properly process an Entry on account of any problems including but not limited to technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to Entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Contest.
Releasees are not responsible for any: (a) telephone, computer, hardware, software, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process Entries; (b) communication disruption or other forces beyond the reasonable control of the Sponsor, including inability to access the Web site, submit Entries or other disruption related to Internet traffic, virus, bug, or non-authorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer from Entrant's access of the Web site, whether human, mechanical or electronic; or (d) incorrect or inaccurate information whether caused by Web site users or by any of the programming or equipment associated with or used in the Contest. Proof of submitting information at Web site is not considered proof of delivery or receipt.
Releasees shall not be liable to any winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entities (whether or not they prove to be valid); equipment failure; terrorist acts; earthquake; fire; flood; war; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor's sole control. Releasees shall not be liable to any winner or any other person for damage to such person's computer or its contents.
The Sponsor reserves the right to cancel or modify the Contest if fraud or any other factor impairs the integrity of the Contest as determined by the Sponsor in its sole discretion. The Sponsor’s decisions as to all matters related to administration of the Contest are final.
If, in the Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers with the entry process), and to cancel, terminate, modify or suspend the Contest, in whole or in part, at any time without notice. In the event of such cancellation, the Sponsor reserves the right to award the prize, in its sole discretion, from all eligible entries received before the time of cancellation.
CAUTION: ANY ATTEMPT BY ANYONE TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. THE PENNSYLVANIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF PENNSYLVANIA SHALL GOVERN THE CONTEST. ENTRANTS WAIVE ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMIT TO THE JURISDICTION OF THOSE COURTS.

Please note on the front left hand corner of your outer envelope that you are requesting the name of the "Winner".
